1.1 These terms and conditions govern participation in team building events (“the Event”) organized by Kstene (Pty) Ltd T/A Teamoting (“the Company”).
1.2 The Company hosts Events at various venues, including restaurants, which are not owned or operated by the Company. By participating, all participants agree to adhere to these terms, as well as the rules of the venue where the Event is held.
2.1 The Company provides all necessary equipment and props for the Event. These items are to be used with care and remain the property of the Company. Participants are prohibited from taking any equipment, props, or materials provided during the Event.
2.2 All logos, slogans, promotional materials, and intellectual property, whether on the Company’s website, social media platforms, or at the venue, remain the exclusive property of the Company. Unauthorized use is strictly prohibited.
3.1 Payment Terms for Standard Events:
3.1.1 Full payment for Standard Events is required no later than seven (7) working days prior to the scheduled date of the Event.
3.1.2 Payment on the day of the Event will not be accepted under any circumstances.
3.2 Refund Policy for Standard Events:
3.2.1 Refunds will only be issued if the Event is cancelled at least three (3) working days in advance.
3.3 Payment Terms for Promotional Events:
3.3.1 Full payment for Promotional Events is required no later than fourteen (14) working days prior to the scheduled date of the Event.
3.3.2 Payment on the day of the Event will not be accepted under any circumstances.
3.4 Refund Policy for Promotional Events:
3.4.1 Refunds will only be issued if the Event is cancelled at least seven (7) working days in advance.
4.1 All participants must behave in a polite and courteous manner at all times. Unlawful, disruptive, or unsafe behavior, including behavior caused by the influence of alcohol or drugs, is prohibited.
4.2 The safety of the Company’s staff and other participants is paramount. The Company reserves the right to stop an Event or exclude any participant(s) engaging in unlawful, unsafe, or disruptive conduct without issuing a refund.
4.3 Any form of verbal, physical, or emotional abuse directed at the Company’s hosts or staff will be grounds for immediate cancellation of the Event without refund.
4.4 Participants must be over the age of 18 to participate in the Event.
4.5 Food and drinks not purchased at the venue may not be brought into the premises.
5.1 The Company, its directors, employees, contractors, agents, or representatives shall not be liable for any loss, damage, injury, or expense of any nature whatsoever, including but not limited to death, personal injury, damage to property, medical costs, or legal expenses, whether arising from negligence, omission, or any other cause. This exclusion of liability applies to the fullest extent permitted by South African law and does not limit liability where such exclusion is prohibited under applicable legislation.
5.2 Participants acknowledge that attendance at the Event and use of the venue and equipment are undertaken at their own risk. The Company is not responsible for any damages, loss, or injuries occurring within the venue, including but not limited to those caused by other patrons, third parties, or environmental factors.
5.3 Participants indemnify and hold harmless the Company against any claim, injury, loss, damage, or expense arising from:
5.3.1 Failure to adhere to the Event rules, safety instructions, or the venue’s policies.
5.3.2 Misuse of equipment, failure to follow game rules, or improper handling of electronic devices, batteries, and cables.
5.3.3 Any act or omission by the participant that results in harm to themselves, other attendees, or Company property.
5.4 Participants acknowledge that the Event may involve the use of electronic equipment, batteries, and cables, which require careful handling. Accordingly:
5.4.1 The Company is not liable for injuries caused by negligence, such as tripping over cables, improper handling of equipment, or exposing electrical components to liquids.
5.4.2 Participants are responsible for their own safety and must exercise due caution when interacting with equipment, following all safety guidelines provided.
5.5 This Liability and Indemnity clause shall apply to the maximum extent permitted by South African law, including but not limited to the Consumer Protection Act, and shall not be interpreted to exclude liability where such exclusion would be unlawful or contrary to public policy.
6.1 Participant Liability for Damages
6.1.1 Participants shall be held liable for any costs associated with damage to the venue, equipment, or props resulting from willful misconduct, negligent behavior, misuse, or failure to follow the provided instructions.
6.1.2 The Company reserves the right to recover the costs of repairs or replacements from the responsible participant(s) and may take legal action where necessary.
6.2 Termination of Participation
6.2.1 The Company reserves the right to deny entry to or remove any participant or group from the Event if their behavior:
6.2.1.1 Endangers the safety of themselves, other participants, or Company staff.
6.2.1.2 Causes damage to property, equipment, or the venue.
6.2.1.3 Disrupts the orderly conduct of the Event or violates the venue’s policies.
6.2.1.4 Includes verbal, physical, or any other form of abuse, harassment, or intimidation toward Company staff, contractors, or representatives.
6.2.2 Such removal may occur without prior warning, and no refunds or compensation will be provided.
6.3 Legal Compliance and Indemnity
6.3.1 Participants acknowledge that any intentional damage or unlawful conduct may be subject to legal consequences under South African law, including but not limited to civil claims for damages.
6.3.2 This clause operates in conjunction with Section 5 (Liability and Indemnity), and participants remain bound by all indemnities and waivers outlined therein.
7.1 By participating in the Event, unless specifically denied in writing prior to the Event, participants consent to being photographed or filmed. Such media may be used on the Company’s website, social media accounts, or other promotional channels without compensation.
7.2 Any video or photographic evidence captured during the Event may be used in legal proceedings should participants engage in vandalism, destruction of property, or abuse toward the Company’s staff.
By participating in the Event, all participants confirm their acceptance of these Terms and Conditions.
